Amicus Brief
In 2003 the Massachusetts Supreme Court handed down the Goodridge decision saying that same sex couples had a constitutional right to marry in Massachusetts. In response, the legislature quickly passed a Civil Union bill meant to placate the court and afford same sex couples the right to a Civil Union but not the right to Marry. The Legislature asked the court to rule on the Civil Union bill as an acceptable alternative to marriage vis-a-vis the Goodridge decision. The court then invited members of the public to submit Amicus briefs opposing or supporting the idea of Civil Unions in lieu of Marriage for same sex couples.
